New Delhi, Oct 20 (PTI) In an attempt to prevent foreigners from getting non-technical jobs, the government has made it clear that citizens of other countries will be taken only for highly-skilled assignments in India and should draw an annual salary of over USD 25,000. In an order, the Home Ministry nullified a Labour Ministry circular which allows one per cent foreigners among the total work force in any project with a minimum of five and maximum of 20 people. "An employment visa is granted to a foreigner if the applicant is a highly skilled and/or qualified professional, who is being engaged or appointed by a company/organisation/ industry/undertaking in India on contract or employment basis," according to the Home Ministry guidelines. Besides, the ministry made it clear that employment visa shall not be granted for jobs for which qualified Indian are available and also for routine, ordinary or secretarial/ clerical jobs. "The foreign national being sponsored for an employment visa in any sector should draw a salary in excess of USD 25,000 per annum," it says. However, this condition of annual floor limit on income will not apply to ethnic cooks, language teachers (other than English), staff working for the Embassy/High Commission concerned in India. The Labour Ministry had ordered that visa applications could be cleared by the Indian missions abroad at their level if the foreign national is skilled and qualified professional, technical experts, senior executives or in managerial positions and those kinds of skills which are not available in India.

Does anyone have any names and suggestions on the best lawyers in the US? Dan19, could you please tell me which lawyer the person consulted with who got his LC approved? I have contacted Carl Shusterman and have a phone appointment with him on Monday. Any ideas would be appreciate since I don't have much time left cuz I need response to the letter by Sept 27, which is two weeks from now.

As per my attorney, NO it won't affect the GC process. However the Job description should remain same as in your Labor Certificate.
Better confirm with your attorney.

My husband just had his performance appraisal today. He is presently working as a Senior Consultant.What we are wondering is that if there is any change in the designation, will it affect the GC process in any way ?
We got our I-140 last month and EAD two weeks back.

Let's hope that it means the next offering from Canon comes in at about that same price point (about USD$2000). Maybe they (Kodak) know something?
More likely it a natural fallout of their recent announcements regarding their positioning (or non positioning) as a camera maker.

I might add that galbraiths site says that Kodak is dropping the digital backs to focus on making large sensors and develop high end DSLR's. Could be intersting.

I want to start a thread for tracking cases which were transfered from one place to other and to estimate that if we are getting in the back of the queue OR receipt date is acknowledged.
My I 485 transfered from TX to CAL and now to NEBRASKA.
131 AND 765 says received and pending at California
package was received at Texas on 23rd July and Cal center issued notice on Sep 24.
Please let me know if anyone has similar case.

There will be a great chance that my parent company will close down my current company after I'm transferred to them. I don't think my current employee will withdraw my I-140 case in the future. Hopefully that I-140 will go thru so I can use its PD for my future PERM/I-140 application.

I'm sure the following questions have been asked several times too. What are the answers in the following scenarios:
After 485 filing and before 180 days:
- Person loses job and is unemployed. Does the 485 stage continue? Does AP and EAD assigned to this person still continue to work?
- If this person finds another job (based on EAD or H1), does the 485 process continue? Or does the whole GC process needs to restart?

As you probably realize, by transferring to another employer you will have to start the GC process all over--though you should be able to keep your May 2008 priority date.
Based on the facts you have provided, I would say that it is unlikely your prospective employer's H-1 would be denied. However, there is never any guarantee. Premium processing usually takes 7-10 days if there is no RFE, but again, there can be no guarantee. (Note that USCIS must refund the $1000 fee if your case is not acted on (approval, denial, or RFE) within 15 days of receipt.)

I am sorry to hear about your mother's situation but there is no dependent visa for parents. You can probably extend her stay for another 6 months, but eventually there will be a time when by law she would have to leave. I also never recommend that one extends their visitor visa, unless ofcourse there is really an emergency situation. I say this because there is likely more chances for your mother to get a denial, and then she would end up loosing her existing multiple entry visa as well. So, dont take that chance.
Also, in her current situation, how are you ever going to manage medical bills? There is no insurance in this planet that will cover any pre-existing conditions. So, my friend believe me when i tell you this that it is better for your mother to live in india than in this country. I can understand that you are a dedicated son, everyone should be. Your $$$ go a long way in india and you can get the best care for her for the money.

Thanks for quick responses..my worry is that USCIS should not put my 485 case in storage just thinkin that my 140 is not approved...though i have the approval in hand they have the online status as processin..i wonder how they follow procedure while approvin case...

not sure if moving to another state is a option...
but i can think of..
1) cancel the insurance
2) apply for another insurance effective from your return date, cancel the existing insurance.
3) take min liability only
4) see if they can suspend it for 2 months.
