The whole process in complicated and needs a lot of back and forth btwn hr/attorney. Most attorney's will take 4-6 months at min.

I have received an RFE on my I-485 application to provide a copy of birth certificate. However, I have submitted the birth certificate and affidavits from my parents when I filed for I-485.
I am from India. Since the name is put after few months of birth, my name is not present in the birth certificate. I am not sure if the RFE is due to this. But all the (or most) people from India would be in the same zone, right (not having name in birth certificate) ?
Is anyone in the same situation as me ? What kind of documents have you submitted for the birth certificate requirement ?

My H1B was filed on April 1st 2007 at Vermont Service Center while i was in India and got selected in the lottery. I came to US on May 13th on H4 visa (I 94 valid till July 18, 2008) and still my papers were under process.
On June 1st, 2007 the approval notice was sent to my employer.
Oct 1st, 2007 they applied for my change of status and on 19th it was returned back as a check for 500$ was not included.
Kindly let me know if we could go for a H1B Transfer and change of status simultaneously with a new employer.
Within what time line i need to apply for the same.

If you need to switch employer you should be on valid H1 status with SSN and have paystubs from current employer for safe side.
Pl consult good immi lawyer for best advice/lawyer of new employer.

Hi,
I recently went through same situation for my spouse on H4. You have 3 options:
1. Call the CBP office where you got I-94 or local CBP office (You can find in Internet, mostly in International Airports) and request them to update thhe I -94. Which may or may not be possible technically. But you may try calling them and schedule an appointment and try this option.
2. Go out of country and come back.
3. File a I539 form to extend non immigrant status. Your employer should help you file it or you may file yourself. It should go to same USCIS service center or office which approved your H1 or H4.
Disclaimer: I am not a attorney. This comment is based on my experience. Please consult and attorney for any legal advise.
For H1b you cannot file I 539 but need to file I 129 which will cost lot more. I guess going out of country and coming back is good option. if you live near border area.

What are your impressions of the D200? Are you happy with it?

I got 2 year EAD from NSC in August 2008.
Wanted to apply for Advance Parole (second time).
Is NSC issuing 2 year AP's ?
Wondering if any body got Advance Parole for 2 years from NSC.
Also, I appreciate if any one can share their experince about INFOPASS to get Advance Parole in case of emergency
(if one did not apply for AP & need to travel urgently).

I am in H1 status and my wife is in H4 status. She received credit for an amount for which she received an 1042-S form. Also received a 1098-T form which shows the credit amount. Where do I show the amount in the 1040 or 1040 EZ ?

My wife's green card was approved on Feb 27th. My wife is currently in India with valid Advance Parole. I received her green card during March 15th. I am planning to visit India during June and bringing my wife along with me. It will be almost 5 months when I come back on July 1st week.
Will it create problem for my wife to re-enter to US? Since she has valid AP and GC card, can she enter without any problem? or does she need to come early since her GC was received ?

There is no special provisions for people living in Haiti to get a visa to come here sooner. You will need to file the regular route. What is your immigration status? You can sponsor your mother only if you are US citizen.

H1B LUDs may be due to PIMS data collection, I heard most of the H1Bs approved after Jan 2004 had LUDs and the status did not change; and 140 could be a regular system touch.

There is a pilot in progress where a combined document has been issued which serves both as EAD and AP and the validity is 2 years... So I would say its a matter of time if the pilot is successful.

Is your friend working? 26 states requires SSN, if your friend is working on SSN required state, how she/he got it? Most of the RN position just required 2 year education how does the individual able to file H1B. Please try to answer as many question as you can. Thanks.

Can you elaborate the process for infopass?
I tried and got mine but when I tried to get an appt for my wife I got a message saying I cannot schedule an appointment.
if not allowing using EAD receipt, book appointment with I-485 receipt. At counter yo can ask EAD question.
